49 North Digital Purchase Terms of Service
By purchasing a product from 49 North Digital (hereinafter the “Product”), you, the purchaser (hereinafter “Student”) enter an agreement with 49 North Digital (“Company”) and agree to the following terms:
Course Deliverables
The deliverables will depend on the purchase. All deliverables will be delivered via our online learning platform.
Students will retain access to the Product for the life of the Product meaning for as long as Company offers and maintains the Product. Company will provide Student with at least one month’s notice should Company need to retire the Product. It is then Student’s responsibility to download all materials from the Product before the retirement date noted by Company.
Privacy and Confidentiality
Your privacy and protection of your personal data is important to us. We will keep your personal data confidential and will never share it with unconnected third parties. Your payment information will be processed by a secure third-party processor. We will be provided with your email address and name but never be provided with your financial information.
Please be aware that some training sessions may be recorded and your name and image/video may be captured. The recordings of the training will be kept and made available to others on the course. If you provide or share any information within these sessions about yourself or your business that information will be shared within the group. Should you not wish to be recorded please ensure that if you attend any training your camera is switched off and your name field is changed to “Attendee” with your initial so that support can still be offered but no personal identifiable information will be captured.

No Refunds
Company has a strict no refund policy on the Product. Student understands and agrees to this.
Cancellation
Student may not cancel their payments for the Product and understands that they are responsible for paying for the Product in full upon registration. Should Student fail to make timely payment, Company may immediately suspend Student’s access to the Product and pursue whatever remedies available to collect the balance owed.
Company may cancel Student’s Product at any time for any reason.
No Master Resell Rights. No Personal Label Rights.
Master Resell Rights and Personal Label Rights are not available for this Product. Student understands that no rights of reproduction are transferred by this Agreement. Student agrees not to create any derivative works of the content found in the Product.
Intellectual Property
You will be provided with course materials. At all times, even following purchase, the intellectual property rights and copyright connected with those materials remain with us 49 North Digital. You have the right to use the materials as learning tools but you are not permitted to duplicate, imitate or provide copies to third parties whether for free or as part of a sale.
Force Majeure
Company shall not be liable or responsible to Student, nor be deemed to have defaulted or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of the Company including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion, or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, lock-outs, strikes or other labor disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
Independent Contractor
Nothing in this Agreement shall be construed to create a partnership, joint venture, employment, or agency relationship. Company agrees only to provide Client with access to the Product, which provides education and information. The information contained in the Product, including any interactions with the instructors, is not intended as, and shall not be understood or construed as, professional advice.
Severability
If any provision of this Contract shall be declared invalid or unenforceable, such provision shall be deemed eliminated from this Contract, and all remaining provisions shall continue in full force and effect.
Liability
Student absolves Company of any and all liability or loss Student may suffer or incur as a result of use of the Product and/or any information and resources contained in the Product. To the extent permitted by law, Student agrees that Company shall not be liable to Student for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for use of the Product.
Warranty
Company makes no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics contained in the Product for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided “as is” without warranty or condition of any kind. Company and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.
Feedback and Complaints
If you have any feedback about the course please do share it with us. It is always great to receive words of praise and also helpful to get constructive comments. We really hope that you love this course as much as we do but if you would like to make a complaint this should be made to made in writing to hello@49northdigital.com.

We intend to rely on the written terms set out in these terms and conditions in respect of the Product delivered to you. These written terms shall constitute the entire agreement between us.
If any provision or part-provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.
These Terms are governed by the laws of England & Wales. The Courts of England & Wales have exclusive jurisdiction over any matter and proceedings arising out of your purchase of the course.
